His re-detention in immigration custody prompted the recent judicial review.\n\nIn her ruling, Judge Paula Xinis stated, "Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority."\n\nEarlier this year, Mr. Abrego Garcia was transferred to a prison facility in El Salvador. The U.S. government later acknowledged that this deportation action was an error. He was subsequently brought back to the United States to face charges related to human smuggling, remaining in custody since his return.\n\nJudge Xinis's order further noted the absence of a valid removal order, thereby preventing the government from deporting Mr. Abrego Garcia "at this juncture."
