The inquiry stems from a video in which Senator Kelly, alongside other Democratic lawmakers, addressed military servicemembers, advising them to consider non-compliance with orders they identified as 'illegal.' This development occurs amidst prior legal inquiries faced by the Trump administration regarding the domestic deployment of National Guard forces and specific airstrikes targeting suspected drug smuggling vessels in the Caribbean.
In an official statement, the Pentagon confirmed, "serious allegations of misconduct against Captain Mark Kelly, USN (Ret.)," have been received. The statement further detailed that "a thorough review of these allegations has been initiated to determine further actions," which may encompass a "recall to active duty for court-martial proceedings or administrative measures."
Senator Kelly, a former Navy captain, combat pilot, and astronaut, was one of six former military or intelligence officials featured in the video. The content of the video prompted a response from the White House.
As a retired officer, Senator Kelly is subject to potential recall to active duty by the Pentagon for court-martial proceedings. This action is considered infrequent, and it is presently unclear whether defense officials will proceed with such a measure.
